California Proposition 65 Warning

In accordance with California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (“Proposition 65”), we provide this general consumer product exposure warning:

WARNING: This product can expose you to chemicals including [name of chemical(s) if known] which are known to the State of California to cause cancer and/or reproductive harm. For more information go to www.P65Warnings.ca.gov.

Additional details:

  • Proposition 65 requires businesses doing business in California to provide a “clear and reasonable” warning before knowingly and intentionally exposing anyone to a chemical listed by the Office of Environmental Health Hazard Assessment (OEHHA) as causing cancer or reproductive toxicity.   • The warning may apply when a product exposes a consumer in California, unless the business can show the exposure is significantly below safe harbor levels established by OEHHA or that no significant risk or reproductive harm would result. Proposition 65 Warnings Website+1

  • Revised regulations require that, for short-form warnings used on or with products manufactured and marked after January 1, 2028, the name of at least one chemical must be identified in the warning. QIMA Blog+1

  • Retailers may share responsibility for placing warnings if they sell under their own brand name, introduce the listed chemical into the product, or have actual knowledge of the exposure and the upstream manufacturer has not provided the warning. Hinshaw & Culbertson LLP

Our position

At Kiesub Electronics, we make every effort to assess our products for compliance with Proposition 65. If any product we offer is required to carry a warning under Proposition 65, we will include the warning on the product label, packaging and/or product listing (as appropriate) to ensure consumers in California are notified accordingly.

If no specific chemical exposure warning appears on a product, it reflects our current assessment that the product either does not require a warning under Proposition 65 or that the exposure risk has not been determined to rise to the level requiring a warning.
Please note that addition of a warning does not indicate that a product is unsafe; rather it is a legal requirement in California under certain exposure conditions.
